This Privacy Policy explains how EmpirioLabs.ai LLC, a New Mexico limited liability company ("Empirio Labs", "we", "us", or "our") handles information when you use our services, including bots and model hosting made accessible through third-party platforms and through APIs.
By using our services, you agree to this Privacy Policy.
Empirio Labs AI operates infrastructure to connect users to various AI models. We are an independent provider and are not owned by or operated by the model developers whose technology we integrate.
When you interact with our services, we may process content you submit, files you upload, generated outputs, account details, authentication data, billing and payment records, API usage records, support messages, and technical information such as timestamps, request metadata, usage metrics, latency, error codes, IP address, user agent, and diagnostic data needed to operate, secure, bill, support, and improve the services.
We also handle limited information about how you find and move through our site, such as the page you enter on, the pages you view, the site or source that referred you, and any marketing or campaign identifiers included in the links you follow. We use this to understand how visitors reach and use our services and to measure our marketing.
Depending on the feature you use, content may include text, image, audio, video, 3D assets, transcription inputs, search or research queries, voice or likeness inputs, model parameters, tool calls, and output files generated at your direction.
We do not ask for or require sensitive identifiers, government IDs, full payment card numbers, or highly sensitive personal information in prompts, and you should not submit that information unless a specific feature clearly requires it and you have the right to provide it.
We use information to route requests, return outputs, provide accounts and API access, meter usage, process billing, prevent fraud and abuse, maintain security, investigate issues, respond to support requests, understand how visitors find and use our services and measure the performance of our marketing, comply with law, enforce our terms, and protect users, providers, and the service.
We do not sell your prompts, messages, files, or outputs. We do not use your prompts, files, or outputs to train any models, and we do not share them with third parties for their own purposes. The only exception is if you separately agree in writing to a specific use, such as a training partnership.
Some requests must be sent to third-party model providers, infrastructure providers, or platforms so they can process the request, host the service, or return an output. Data sent to those services is subject to their own terms, privacy policies, safety rules, and retention practices. Where available and appropriate, we use provider settings intended to limit training on customer content.
We retain different categories of information for different purposes and lengths of time. The following describes our general retention practices:
Retained while your account is active and for any period required to meet legal, accounting, audit, or tax obligations. This includes account identifiers, billing entries, and transaction history.
Metadata about your requests, including request identifiers, timestamps, model and endpoint used, token counts, latency, cost, and status, is retained indefinitely so you can review historical usage in your dashboard. These records do not include the content of your prompts, messages, or files.
Files produced by our services are typically delivered through signed, expiring URLs. As a general practice, signed URLs expire after 7 days, and the underlying files are retained on our storage for approximately 30 days before being deleted by our automated cleanup processes. We may retain files for longer periods when needed for operational, legal, security, or compliance reasons.
Files you attach in the playground (such as images, audio, or video for editing, transcription, or other inference) are delivered through signed, expiring URLs and are retained for a shorter window, approximately 48 hours, before being deleted by our automated cleanup processes. We may retain these files for longer periods when needed for operational, legal, security, or compliance reasons.
If you use our hosted Playground, your conversations are automatically saved to your account so you can resume them later. You can delete any saved chat from your account at any time. A per-account cap on saved chats applies and can be reduced or disabled on request.
Configuration and billing metadata for GPU Cloud instances are retained with your account so you can review usage and spend. The ephemeral storage attached to a GPU instance is deleted when the instance is stopped or destroyed, so do not rely on it for long-term storage.
Agent configuration, status, plan, and billing metadata are retained while the agent exists. Credentials for any messaging channels or connected tools you link are stored encrypted and are removed when you disconnect them or delete the agent. We do not retain the content of agent messages beyond what is needed to deliver them and record usage.
If you subscribe to a plan, we keep your subscription status, the plan you are on, your billing interval, your current billing period dates, and per-period counters of how much of each weekly allowance you have used. These records are kept for the life of the account for billing, support, and accounting reasons. Allowance counters record quantities only, such as tokens, seconds, characters, or number of generations. They contain no prompt, message, or output content.
Logs of account-level security events, such as sign-ins, password changes, multi-factor changes, and similar activity, are retained for a limited period for security and abuse-prevention purposes.
We retain standard backups of our databases for a limited period to enable disaster recovery. Backups are encrypted at rest.
We may delete, expire, disable, restrict, preserve, or review information when needed to operate the service, enforce our terms, investigate abuse, resolve billing or chargeback disputes, respond to rights-holder or legal notices, comply with law, protect safety or security, or prevent harm.
You can request deletion of your account and associated information at any time by contacting support@empiriolabs.ai. We will honor the request promptly, subject to any legal hold, retention obligation, or operational need described above. Some records, such as billing entries and abuse-related events, may be retained for the period required by law.
Information held by third-party model providers, payment processors, or platforms is subject to their own retention policies, which we do not control.
For GPU Cloud, we handle instance configuration, status, region, and billing metadata to operate and bill the service. We do not access the contents of the workloads you run on an instance as part of normal operation. Temporary instance storage is deleted when the instance is stopped or deleted and is not backed up.
For Hosted Agents, we handle agent configuration, status, plan, and billing metadata to operate and bill the service, and we store the integration credentials you connect in encrypted form so your agent can use them. We do not retain the content of the messages your agent processes as part of normal operation; messages pass through our systems only to deliver them and to record usage for billing, and any conversation memory your agent keeps is governed by the agent settings you choose. You can disconnect an integration or delete an agent at any time, which removes the stored credentials for that connection.
We may share limited information with service providers that help us operate Empirio Labs, including hosting, database, authentication, storage, delivery, payment, email, analytics, logging, monitoring, anti-abuse, and model-provider services. We may also disclose information if we reasonably believe it is required by law, necessary to enforce our terms, needed to respond to rights or takedown requests, or appropriate to protect the rights, safety, or security of users, providers, the public, or the service.
To measure and improve our own advertising, we may share limited marketing-measurement information with the advertising platforms we use, such as whether a referred visit led to a signup or purchase and the campaign identifiers associated with it. We do not share your prompts, files, or outputs with third parties for their own advertising or marketing purposes.
Our payment processor handles subscription checkout, recurring charges, cancellations, and the related billing, tax, and receipt information in the same way it handles one-time credit purchases.
International data transfers. We are based in the United States and process information there and in the locations of the service providers described in this policy. Where we receive personal data protected by EU, UK, or Swiss data protection law, we rely on recognized transfer safeguards, including the European Commission's Standard Contractual Clauses and the UK Addendum where applicable. A data processing agreement (DPA) incorporating these safeguards is available to business customers on request at support@empiriolabs.ai.
We use reasonable technical and organizational measures to protect information against unauthorized access, alteration, disclosure, or loss. No system is perfectly secure, and we cannot guarantee absolute security.
Depending on how you access our services, you may be able to stop using a bot or integration, rotate API keys, update account details, change communication preferences, or request access, correction, export, or deletion of information we control. Some records may be retained where needed for security, fraud prevention, billing, chargebacks, tax, legal compliance, dispute handling, abuse prevention, backups, or legitimate operational purposes.
For data held by third-party platforms, payment processors, or model providers, please contact those providers directly.
Depending on where you live and which laws apply, you may have rights to access, correct, delete, export, restrict, object to, or opt out of certain processing of personal information. We will honor legally required requests when we can reasonably verify the request and when no exception applies.
For notice-at-collection purposes, the categories of information we collect and the purposes for collection are described in this Privacy Policy, including service operation, account access, billing, support, security, abuse prevention, diagnostics, compliance, reliability, and marketing measurement. We do not sell personal information. We do not knowingly share personal information for cross-context behavioral advertising unless an appropriate notice, consent, or opt-out flow is active for the visitor's region.
Our services are not directed to children under the age required by local law, and we do not knowingly collect personal information from children.
We may update this Privacy Policy from time to time. When we do, we will update the effective date above. If changes are significant, we may provide additional notice where appropriate.
To access certain features of Empirio Labs, you may be required to create an account. You may register directly using an email address and password or authenticate through supported third-party sign-in providers.
We use authentication data to provision your account, securely log you into the platform, protect the service, and communicate with you regarding your account or support requests. We do not sell authentication data or share it with third parties for their own marketing or advertising purposes.
We use YouTube API Services to publish and manage videos on our own YouTube channel. This use does not give us access to your YouTube account, and we do not collect, store, share, or sell YouTube data about you through it. The only YouTube data we keep is information about the videos we publish on our own channel, such as their identifiers, titles, and publication status.
When you watch or interact with our videos on YouTube, the YouTube Terms of Service apply: https://www.youtube.com/t/terms. How Google handles information on YouTube is described in the Google Privacy Policy: https://policies.google.com/privacy.
If you ever authorize an Empirio Labs application to access a Google or YouTube account, you can revoke that access at any time in your Google account's security settings: https://security.google.com/settings/security/permissions. When access is revoked, we delete the data obtained through it within 30 days, unless the law requires us to keep it longer.
